宪法第２０条修正案第３条：If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

如果大选后还未宣誓President elect（这时已不仅是候选人，而是赢得选举的下一任总统）死了，那么赢得选举的副总统将作为总统参加宣誓并担任下一任四年的总统。这之间不需要多长时间的过渡期。如果下一任总统只是昏迷，下一任副总统应该成为临时总统，直到总统能够行使总统的职责为止。这个情况同样不需要过渡期。

副总统后是众议院议长，参议院多数党领袖，再往后是各部部长，按各部创建时间为序排列。

这次大选后众议院应该还是由共和党控制，参议院难说。可能的顺序会是

1. Paul Ryan
2. Mitch McConnell  或民主党在参议院的领袖，很可能会是Chuck Schumer。
3. 国务卿John Kerry
4. 财政部部长Jack Lew
5. 国防部部长Ashton Carter
6. 司法部部长Loretta Lynch
等等

2. Speaker of the House of Representatives　国会发言人
3. President pro tempore of the US Senate　参议院副主席（参议院主席是副总统）
4. Secretary of State　国务卿
5. Secretary of the Treasury　财政部部长
6. Secretary of Defense　国防部部长
7. Attorney General　司法部部长
8. Secretary of the Interior　内政部部长
9. Secretary of Agriculture　农业部部长
10. Secretary of Commerce　商务部部长
11. Secretary of Labor　劳工部部长
12. Secretary of Health and Human Services　卫生及公共服务部部长
13. Secretary of Housing and Urban Development　住房及城市发展部部长
14. Secretary of Transportation　交通部部长
15. Secretary of Energy　能源部部长
16. Secretary of Education　教育部部长
17. Secretary of Veterans Affairs　退伍军人事务部部长
18. Secretary of Homeland Security　国家安全部部长

每一个继承人本身必须满足宪法关于当总统的条件。现任的内政部部长Sally Jewell出生时是英国人，后来才取得美国国籍，所以她不能当总统。如果现任总统到司法部部长都没了，农业部部长就会跳过内政部部长继任总统。
