Dallas officer in wrong apartment fatally shoots neighbor

DALLAS — Authorities are seeking a manslaughter warrant for a Dallas police officer who shot and killed a neighbor after she said she mistook his apartment for her own, police said Friday.

It was not clear what the officer may have said to 26-year-old Botham Jean after entering his home late Thursday. But given what investigators currently know about the case, they decided to pursue a manslaughter case, police said.

"Right now, there are more questions than we have answers," Police Chief U. Renee Hall said at a news conference Friday afternoon. She said she spoke to Jean's sister to express condolences to the family.

It was also unclear if the officer was in custody. Hall said she did not know the whereabouts of the officer, whose name was not released.

According to police, the officer returned home in her uniform after her shift. She called dispatch to report that she had shot a man, and she later told the officers who responded that she believed the victim's apartment was her own when she entered it.

The responding officers administered first aid to Jean, a native of the Caribbean country of St. Lucia who attended college in Arkansas and worked for accounting and consulting firm PwC. Jean was taken to a hospital, where he died.


Authorities said Friday, Sept. 7, 2018, that a Dallas police officer returning home from work shot and killed Jean, a neighbor, after she said she mistook his apartment for her own. The officer called dispatch to report that she had shot the man Thursday night, police said.
Hall said the officer's blood was drawn to be tested for drugs and alcohol. She declined to speculate as to whether fatigue or other factors may have factored into the shooting. She also said the Texas Rangers will conduct an independent investigation.

Jean grew up in St. Lucia and attended Harding University in Searcy, Arkansas, where he majored in accounting and information systems and often led campus worship services before graduating in 2016, the school said in a statement. That July, he went to work for PwC in risk assurance. The company in a statement that it was "simply heartbroken to hear of his death."

Family and friends described Jean as a devout Christian and a talented singer. His uncle Ignatius Jean said the slaying left relatives devastated and looking for answers.

"You want to think it's fiction ... and you have to grapple with the reality," he said.

He called Jean a "brilliant" man of "impeccable character" and said news of his death had rippled across the small island nation of St. Lucia.

"Botham was in the prime of his life," his uncle said.

Nathan Monan, a friend from Harding University, said Botham Jean was kind to everybody and would often lead people in song during chapel at the private university in Arkansas.

"He lived what he spoke," Monan said, adding that Jean's death has stirred emotions of overwhelming sadness and anger. "This doesn't make sense to anybody right now."

A YouTube video posted in 2014 shows Jean making his pitch to become the university's student association president.

"I want to serve," he says in the video. "My Harding experience has really inspired me to want to serve and I want every student at Harding to have the best Harding experience possible."

Authorities have not said how the officer got into Jean's home, or whether his door was open or unlocked. The apartment complex is just a few blocks from Dallas police headquarters.

Residents of the complex said they can access their units with a key or through a keypad code.

Jeffrey Scherzer, who lives there, said when he returned home after the shooting, an officer escorted him to his apartment and warned him to steer clear of a blood trail.

Two women who live on the second floor near where the shooting happened said they heard a lot of noise late Thursday.

"It was, like, police talk: 'Open up! Open up!'" Caitlin Simpson, 20, told The Dallas Morning News.

Yazmine Hernandez, 20, was studying with Simpson when they heard the commotion.

"We heard cops yelling, but otherwise had no idea what was going on," Hernandez said.

Attorney Lee Merritt, who has been involved with high-profile cases in North Texas, said Friday the officer should have already been arrested, like any other person in a similar situation.

达拉斯一位警察(自述),她进入邻居的公寓,误以为是她自己的,就把该邻居枪杀了。

可怜的邻居,一生终止于26岁,新闻说他是虔诚基督徒,歌手,出生于加勒比岛国,在一家会计咨询公司工作,以及从相片可以看出,但是报道没有explicitly提及的,是黑人。

非洲裔应该是的,但是可能还不是美国人。杀他的是白人女警察。

德州决定暂缓逮捕那位杀人警察。 理由是需要调查。

死者母亲问,种族是不是一个因素,如果是个白人结果是否会不同。

肤色估计会被讨论,男女也可能,因为是女警察。

我看fox报道后面的评语,还确实存在真正的种族主义者,有人说,怎么可能走错,狒狒的味道非常明显。

今天看到相关报道了。
邻居听到女警用非常大的声音敲门,并高喊着:开门!开门!
受害者打开门后,就被她射杀身亡了。

这事儿女警说她走错楼层了,以为是自己家,所以拔枪自卫。这个说法我觉得站不住脚,她是独自租住在这栋大楼,那么她敲门大喊开门是给谁听的?

她的说法站不住脚,大多数人不买账,包括保守党派。

相当多评语质疑为什么还不批捕,她现在是带薪休假!官方说需要时间调查,但是大家明白如果她不是警察早就被逮捕了,有人呼吁说她已经下班,不是执行任务,不该被当作执行任务的警察来审判。

CNN报道,该警察Amber Guyger (琥珀·盖哥)在星期天晚上被以“过失杀人”罪批捕。当晚花30万美金保释了。https://www.cnn.com/2018/09/09/u ... hem-jean/index.html

她是警队精英小组的成员,而且是唯一的女性。
据说她当时射击后,第一个电话是打给警队工会的,而不是急救中心,所以很多人目前在质疑她的动机。
有人认为她是酗酒或者嗑药之后神志不清下的行为,但我不这么认为。她的自我保护意识太出色。

工会的保护力量非常强。之前一个例子,某警察去黑人家里搜捕,家里只有祖母和小孩子,他杀死6岁的黑女孩还说是人家祖母攻击他,警察同事说祖母没有攻击,警察局开除他,但是在工会要求下重新聘用了。

美国暴力机关不存在“为人民服务”政治思想教育。警察们有权利self-serving,只要足够聪明合法就行,更有体制问题,执行任务杀错人基本没有代价,可以相对随意动枪。赔款是国家或纳税人支付,更有工会和自己体系的保护——明目张胆,理所当然。

中国的“为人民服务”,虽然大家不信,也不见得都能够做到,但是相当于紧箍咒,存在就是一种激励和威慑,存在就是先进。有无政治思想教育的影响,可以参照共军国军的行为的区别。这种凶煞暴力的职业,没有思想教育(或宗教熏陶),长期下来心理会出问题的。

DALLAS –  The Latest on a fatal shooting involving an off-duty Dallas police officer (all times local):

11:35 p.m.

Protesters gathered at police headquarters in Dallas to speak out against the shooting death of a black man by a white officer who says she mistook his apartment for hers.

The Dallas Morning News reports that community activists organized the rally Monday to protest last week's shooting of 26-year-old Botham Jean. Officer Amber Guyger was arrested Sunday on a manslaughter charge and released on bond.

An arrest affidavit that gives a narrative of what happened was released Monday. It appeared to be based almost entirely on the officer's account.

Attorneys for Jean's family say it's "self-serving" and contradicts neighbors' accounts.

Several dozen protesters blocked traffic as they marched about half a mile from police headquarters. They were also denouncing the fatal shooting of a man by a security guard on Sept. 1.

Police, some on horseback, followed. Officers fired pepper balls to help control the crowd at one point.

The rally ended back at the headquarters. Leaders asked protesters to return for another rally Wednesday.

9:30 p.m.

Attorneys for the family of a black man shot dead by a white Dallas police officer in the man's own home say the arrest affidavit contradicts neighbors' accounts.

The affidavit prepared by a Texas Ranger was released Monday and appeared to be based almost entirely on Officer Amber Guyger's account of the shooting of 26-year-old Botham Jean. Guyger was arrested Sunday on a manslaughter charge in the Thursday shooting.

The affidavit says Guyger mistook Jean's apartment for hers and that his front door was ajar when she entered. She also told investigators that she shot Jean after he refused her verbal commands.

An attorney for Jean's family, Lee Merritt, said at a news conference Monday evening that two independent witnesses have told him they heard knocking on the door in the hallway before the shooting.

He said one witness reported hearing a woman's voice saying, "Let me in! Let me in!" Then they heard gunshots, after which one witness said she heard a man's voice say, "Oh my God! Why did you do that?"

Merritt said he believes those were Jean's last words.

Another lawyer for the family, Benjamin Crump, said the affidavit "is very self-serving."

3:50 p.m.

An investigator says a Dallas police officer who shot and killed her neighbor after mistaking his apartment for her own said that when she inserted her key in his door, it opened because it had been slightly ajar.

David Armstrong of the Texas Rangers wrote in an arrest affidavit released Monday that Officer Amber Guyger said it was nearly completely dark inside the apartment when she entered it Thursday night and she thought she was encountering a burglar in her home.

He says Guyger said the person ignored her verbal commands and she fired twice. One struck Botham Jean in the chest and he later died.

The affidavit says Guyger was on the phone with 911 reporting the shooting when she turned on the apartment lights and discovered she was in the wrong apartment. It says Jean's apartment was the one right above Guyger's and the apartment layouts and exterior hallways were nearly identical.

Authorities say a Dallas police officer said she shot a neighbor whose home she mistakenly entered last week after he ignored her "verbal commands."

Noon

The mother of a man who was gunned down inside of his Dallas home by a police officer who said she mistook his apartment for her own says investigators still haven't given her family an account of what happened.

Allison Jean, whose 26-year-old son Botham Jean was killed Thursday by Officer Amber Guyger, said at a news conference Monday that she's asked a lot of questions but has been told there are no answers yet.

Lawyers for the family questioned why it took three days for Guyger to be charged. One said Guyger should have been in handcuffs the night of the shooting, but she was only booked on a manslaughter charge Sunday night.

They also wondered why, based on news reports of what happened, Guyger was so quick to use deadly force.

10:45 a.m.

The Dallas County district attorney says her office will present the case of a police officer who fatally shot a neighbor to a grand jury, which could decide that a stronger charge than manslaughter is warranted.

District Attorney Faith Johnson said at a news conference Monday that her office will first collect all of the evidence it can surrounding Thursday's fatal shooting of 26-year-old Botham Jean by Dallas police Officer Amber Guyger.

Guyger was arrested Sunday night on a manslaughter charge and was booked into Kaufman County jail and released on bond.

When asked why Guyger was allowed to surrender somewhere other than Dallas County's jail, Johnson said the decision was made by the Texas Rangers, who oversaw the investigation.

Police have said that Guyger told officers who responded to the shooting that she had mistaken Jean's apartment for her own.

Dallas Mayor Mike Rawlings says an off-duty police officer charged in the shooting death of a neighbor had parked on the wrong floor of their apartment complex's parking garage.

Rawlings said Sunday that the 30-year-old officer , Amber Guyger, drove to her apartment complex Thursday night after her shift. Authorities say the four-year veteran of the police force told officers after she shot 26-year-old Botham Jean that she had mistaken his apartment for her own.

Guyger was arrested on a manslaughter charge and released on bond Sunday.

The Dallas County medical examiner's office said Monday that Jean died of a gunshot wound to the chest and it ruled his death a homicide.

A white Dallas police officer who says she mistook her black neighbor's apartment for her own when she fatally shot him has been arrested on a manslaughter charge.

Officer Amber Guyger was off duty and returning to the South Side Flats, where she and 26-year-old Botham Jean both had apartments, when the shooting occurred Thursday. Many questions remain about what led the officer, who has been on the police force for four years, to shoot Jean.

Lawyers for Jean's family had been calling for Guyger's arrest since the shooting, saying the fact she had remained free days later showed she was getting favorable treatment. She was arrested Sunday and later released on bond.

The group Mothers Against Police Brutality said the arrest is a "first step" toward justice and accountability.

1. 有几十人去抗议游行了半英里。说周三还要继续。

2. 将由大陪审团grand jury 裁决判什么罪行。

3. 杀邻居的警察盖哥说,星期四晚上,邻居门是微微开着的,里面黑,她以为入室盗窃,而对方不听她命令,于是就开枪了。

4. 被害黑邻居(Botham Jean鲍瑟姆·吉恩)的律师说,两位邻居们听到敲门,一位听到女声“让我进去!让我进去!” 另一位在枪响后听到男声:“天哪,你为什么那样干?”律师认为这是吉恩最后遗言。

5. 调查机构出具的证词写走廊等高度相似。(警方出具的证词袒护之意明显,因为杀邻居警察一路上经过十几户人家,若干门口的装饰有明显不同,包括被害者门口的红地毯,非常醒目。之前三天不逮捕,而是带薪休假,也是明显袒护)

更新:

警方去搜了死者的房间,说发现大麻。

死者律师抗议,认为警方在抹黑受害者:警方不去调查杀人者的罪行,而是去找被害者有什么黑点。

杀人警察曾抱怨楼上(即被害者的公寓)的噪音,不止一次。

媒体揭露,杀人警察在不同时间写的供词相互矛盾,有时候说打不开门,有时候又说门是开着的。
